The rules that apply to anyone using Fugaji, on the website, in the web console and in the mobile app.

1Purpose and acceptance
These terms govern access to the Fugaji service and its use. They form a contract between Fugaji, the publisher of the service, and you, whether you use it personally or on behalf of a farm.
By creating an account, joining an existing organisation or using the service in any way, you accept these terms. If you do not accept them, do not use the service.
The processing of your personal data is described in the privacy policy, which forms part of these terms.
2The service
Fugaji is livestock management software available from a browser and from an Android and iOS mobile app. It lets you, among other things:
- keep an inventory of animals, their identification, their pedigree and their history;
- record health, treatment, vaccination, breeding, weighing, feeding and production events;
- organise a team's work: tasks, assignments, completion proofs, voice notes and photos;
- exchange messages between members of the same organisation;
- publish an online shop and receive orders;
- follow the position of animals fitted with a connected collar or ear tag and receive virtual-fence alerts, where the organisation has subscribed to that option;
- ask questions of an assistant, where that feature is enabled on the installation you use.
The mobile app works offline: entries made without a network are kept on the device and sent to the server as soon as a connection is available.
Not every feature is available everywhere or on every plan. The service itself indicates what is enabled on the installation you use; a feature whose provider is not configured is hidden rather than presented as coming soon.
3Who may use Fugaji
The service is aimed at livestock professionals and their teams. You must be at least 18, or the age of majority in your country if that is different, to create an account.
Fugaji is not intended for children and is not designed for them. We do not knowingly collect data concerning a minor. If you believe a minor has created an account, write to contact@fugaji.com and we will delete the account and its data.
If you use the service on behalf of a farm, a cooperative or a company, you confirm that you are authorised to bind it, and these terms then apply to that entity too.
4Accounts and organisations
An account is personal. You are responsible for the accuracy of the information you provide, for the confidentiality of your password or one-time code, and for everything done from your account. Tell us without delay if you suspect unauthorised access.
Each organisation is a separate space. An organisation's data is visible only to its members, according to the role and permissions its administrator grants them. Roles run from administrator to veterinarian, accountant, farm manager and farm worker; permissions can be adjusted member by member.
An organisation's administrator invites and removes members, sets their permissions, manages the subscription and may delete the organisation. They are responsible for the data their team records and for the legitimacy of the invitations they send.
Farm data belongs to the organisation, not to Fugaji. We host and process it to provide the service; we do not sell it and we do not use it for anything else.
5Subscriptions and payment
The service is offered by subscription, taken out per organisation rather than per user. Each plan sets limits — number of farms, animals and users, access to connected devices, to the shop and to the assistant — which the web console displays at all times.
A trial period may be opened when the organisation is created. When it ends, access remains possible but features beyond the free plan's limits are blocked until a subscription is active.
In this version, a subscription is taken out, changed and paid for from the web console only. The mobile app shows the current plan, usage and payment history, but offers no purchase.
Payments are collected by mobile money through our payment provider. We neither receive nor keep any card number or mobile money PIN: only the transaction reference, its amount, its currency and its status are recorded.
Prices are shown in the organisation's currency, plus any applicable taxes. A paid subscription is not refundable pro rata, unless a mandatory legal provision says otherwise or we agree in writing. A change to a cheaper plan takes effect when the current period renews.
If payment fails, the subscription falls into arrears and is then suspended. Data is retained during suspension; it is deleted if the organisation is subsequently deleted, under the conditions described on the « Delete your account » page.
6Acceptable use
You agree not to use the service to:
- break the law, in particular on animal health, transport, slaughter, veterinary medicines or trade;
- publish unlawful, violent, hateful, sexually explicit or defamatory content, or content inciting animal cruelty;
- harass, threaten or impersonate someone, or send unsolicited messages;
- offer for sale what you have no right to sell, or mislead a buyer about the nature, the health status or the origin of an animal or a product;
- access data that does not concern your organisation, circumvent access controls, probe or disrupt the infrastructure;
- extract the service's content at scale, automate it beyond normal use, or resell it;
- upload a file containing malicious code.
You remain responsible for the accuracy of the records you enter, in particular where they serve as health or commercial evidence.
7Published content and zero tolerance
The service lets you publish listings, send messages and fill in a profile. You keep ownership of what you publish and you are responsible for it. You grant us the strictly necessary right to host it, display it to its intended recipients and make technical copies of it so the service can work.
Zero tolerance: objectionable content and abusive behaviour are not allowed on Fugaji. An account that publishes such content is disabled, including on a first offence where that offence is serious.
Two tools are available to every signed-in user:
- Report
- Available on every listing, every conversation, every message and every profile. A report states a reason — spam, scam, offensive content, illegal content, animal cruelty, or other — and may include a description.
- Block
- Available on every profile and every conversation. A blocked person disappears from your marketplace results, their messages are no longer shown to you, and they can no longer write to you. A block can be lifted at any time from the list of blocked people.
We undertake to review every report and to act within a maximum of 24 hours. Depending on severity we dismiss the report, issue a warning, hide the content or disable the account concerned. Manifestly illegal content is removed and may be passed to the competent authorities.
An abusive report — repeated and clearly unfounded — may itself lead to a measure.
8Marketplace: Fugaji is not a party to the sale
The marketplace and the public shops let an organisation present its animals and products, and let a buyer place an order. Fugaji provides the technical space only.
Fugaji is not a seller, not a buyer, not an agent, not a broker and not a guarantor. The contract of sale is formed exclusively between the buyer and the seller. We are not a party to the transaction and we guarantee neither its completion, nor payment, nor delivery.
The seller alone is responsible for the description of their offer, its price, the conformity and health status of what they sell, the accompanying documents required by regulation, and their tax obligations. The buyer alone is responsible for checking what they are buying before concluding.
Disputes about a sale are settled between the buyer and the seller. We may nonetheless remove a listing, suspend a shop or disable an account where these terms are not respected.
Where an order is paid by mobile money through the service, our role is limited to passing the payment instruction to the provider and recording the transaction reference.
9Animal health: the service does not replace a veterinarian
Fugaji is a recording and organisation tool. It does not diagnose, does not prescribe treatment, and in no case replaces the examination, advice and prescription of a veterinarian or another qualified professional.
Vaccination reminders, withdrawal periods after treatment, production alerts, task suggestions and inbreeding calculations are aids. They rest on the data you enter and on general rules; they may be incomplete or unsuited to your situation. You remain the sole judge of the decisions you take about your animals.
The assistant, where enabled, produces automatically generated answers. They may be inaccurate. Do not use them as veterinary, legal, tax or financial advice, and check anything important with a professional.
Positions reported by collars and virtual-fence alerts depend on equipment, radio networks and batteries that we do not control. They are not a safety device and must not be the only means of watching over a herd.
10Intellectual property
The software, the Fugaji brand, the logos, the interface, the documentation and the content we publish belong to us or are licensed to us. They are protected by intellectual property law.
We grant you a personal, non-exclusive, non-transferable and revocable right of use, limited to the duration of your subscription and to the use these terms provide for. Any other use — copying, decompiling, resale, making available to a third party — is prohibited without our written agreement.
Your data and your content remain yours. This right of use transfers no ownership of them to us.
11Availability and changes to the service
We do our best to keep the service available, but we do not guarantee uninterrupted or error-free operation. Interruptions may occur for maintenance, updates, incidents, or because of a third party — host, operator, payment provider, radio network.
The service evolves. We may add, change or withdraw features. When an important feature is withdrawn or deeply changed, we tell the administrators of the organisations concerned by email or in the service.
12Liability
The service is provided as is. To the extent the law allows, we are not liable for indirect losses: loss of business, loss of profit, loss of livestock, loss of customers, loss or corruption of data resulting from non-compliant use, nor for decisions taken on the basis of the information the service displays.
To the extent the law allows, our total liability under these terms is capped at the amounts actually paid by the organisation concerned during the twelve months preceding the triggering event.
None of these limitations applies in the event of wilful misconduct or gross negligence, nor where the applicable law prohibits them.
You indemnify Fugaji against third-party claims arising from content you publish, sales you conclude or use of the service contrary to these terms.
13Suspension and termination
You may stop using the service at any time. Deleting an account and deleting an organisation, together with the 30-day grace period that applies to the latter, are described in detail on the « Delete your account » page.
We may suspend or terminate access, with reasonable notice where circumstances allow and without notice where the seriousness requires it, in the event of non-payment, breach of these terms, objectionable content, an attack on the security of the service or a legal obligation.
After the relationship ends, the clauses on intellectual property, liability, governing law and data protection continue to apply.
14Personal data
The personal data the service processes, the providers who have access to it, the retention periods and the rights you hold are described in the privacy policy.
We show no advertising, we use no advertising tracker and we sell no data.
15Changes to these terms
We may amend these terms to reflect a change in the service, in regulation or in our providers. The date of the last update appears at the top of the page.
A substantial change is announced at least 30 days in advance, by email to the administrators of the organisations and by a notice in the service. Continuing to use Fugaji after it takes effect counts as acceptance. If you do not accept it, you may delete your account or your organisation before that date.
16Governing law and disputes
These terms are governed by the law of the Democratic Republic of the Congo. Any dispute about their validity, interpretation or performance falls to the competent courts of Kinshasa, without prejudice to any mandatory protective rules you benefit from in your country of residence.
Before taking any action, please write to us at contact@fugaji.com: most disagreements are settled that way.
